Please read these Terms carefully before using KinPass. By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use KinPass.
These Terms of Service ("Terms") form a binding agreement between you and KinPass Inc. ("KinPass," "we," "us," or "our") governing your access to and use of the KinPass mobile application and related services (collectively, the "Service"). By creating an account, you represent that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated into these Terms by reference.
KinPass is a care coordination platform that allows individuals ("Owners") to create care profiles for a person they are responsible for caring for (a "Care Recipient"), record care-related information, and share defined levels of access to that information with other individuals ("Caregivers") they invite. The Service includes features such as medical information tracking, activity logging, an AI-powered care assistant, care handoff reports, notifications, and optional integration with third-party healthcare systems.
You must be at least 18 years old and legally capable of entering into a binding contract to create a KinPass account. KinPass accounts are intended for use by parents, guardians, family members, and caregivers acting on behalf of a Care Recipient — the Service is not directed at children, and Care Recipients themselves are not expected to be account holders or users of the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to keep it up to date.
KinPass supports multiple account roles within a household, each with different levels of access:
Owners are solely responsible for determining who to invite as a Caregiver and what level of access to grant them. KinPass is not responsible for an Owner's decisions regarding who is given access to a Care Recipient's information.
KinPass is not a medical device and does not provide medical advice, diagnosis, or treatment. Information stored in or generated by the Service — including AI-generated summaries, insights, and care assistant responses — is intended solely to help you organize and communicate care information you provide, and is not a substitute for the independent judgment of a qualified healthcare professional.
You should never rely on KinPass in a medical emergency. If you believe a Care Recipient is experiencing a medical emergency, contact emergency services (911 in the United States) immediately. KinPass is not responsible for the accuracy of information entered by you or other users of your household, and you are solely responsible for verifying medical information — including medications, dosages, and allergies — against authoritative sources such as the Care Recipient's healthcare providers.
KinPass may allow you to connect a Care Recipient's records from a supported healthcare provider through MyChart / Epic's patient-authorized data-sharing systems. This connection is initiated and authorized directly by you through the provider's own secure login, and KinPass does not receive or store your healthcare portal credentials. You are responsible for ensuring you have the legal authority to access and import a Care Recipient's health records through this feature.
KinPass offers Free, Individual, and Family subscription plans. Paid subscriptions are billed through the Apple App Store or Google Play Store, and are subject to each platform's own payment terms in addition to these Terms.
You retain ownership of all information you submit to KinPass, including care profiles, medical information, photos, and activity logs ("User Content"). You grant KinPass a limited, non-exclusive license to store, process, and transmit your User Content solely as necessary to operate and provide the Service to you and the Caregivers you've authorized — including generating AI-powered summaries and insights from that content on your behalf. We do not sell your User Content, and we do not use it to serve advertisements.
You are solely responsible for the accuracy and legality of any User Content you submit, and for having any necessary rights or consents to share information about a Care Recipient with the Caregivers you invite.

We implement administrative, technical, and physical safeguards designed to protect the confidentiality and integrity of information stored in KinPass, including access controls that restrict medical information to authorized users of a household. No method of electronic storage or transmission is completely secure, however, and we cannot guarantee absolute security. See our Privacy Policy for more detail on how we handle your data.
The Service, including its design, features, and underlying technology, is owned by KinPass Inc. and protected by intellectual property laws. These Terms do not grant you any right to use KinPass's trademarks, logos, or branding without our prior written consent.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, or if we reasonably believe your use of the Service poses a risk to KinPass, other users, or a Care Recipient. Upon termination, your right to use the Service will immediately cease; certain provisions of these Terms will survive termination, including Sections 5, 10, 13, and 14.
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Kinpass does not warrant that the service will be uninterrupted, error-free, or that any AI-generated content will be accurate or complete.
To the fullest extent permitted by law, kinpass inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the service, even if advised of the possibility of such damages. Kinpass's total liability for any claim arising from these terms or the service shall not exceed the amount you paid to kinpass in the twelve months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify and hold harmless KinPass Inc. and its officers, employees, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
